Terms of Service

By accessing or using StreamCart's platform, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to that organization.

If you do not agree to these Terms, you must not use the Services. We reserve the right to update these Terms from time to time. Material changes will be communicated to you via email or through a notice within the dashboard. Continued use of the Services after such notice constitutes acceptance of the updated Terms.

To use certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@streamcart.it if you become aware of any unauthorized use of your account.

You may not share your account credentials with any third party. Each account is issued to a single merchant organization; if you need additional seats or team access, please refer to the multi-user features available on Growth and higher plans. StreamCart reserves the right to suspend or terminate accounts that violate these Terms.

You must provide accurate and complete registration information and keep this information current. StreamCart may require identity verification before allowing access to certain features or before processing refund requests.

Access to the StreamCart platform is provided on a subscription basis. Subscription fees are billed in advance on a monthly or annual cycle, as selected at the time of sign-up. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms.

We accept major credit cards and PayPal. By providing payment information, you authorize StreamCart to charge the applicable subscription fees to your payment method on each billing cycle. If a payment fails, we will attempt to retry the charge and notify you by email. Accounts with persistent payment failures may be suspended after a reasonable grace period.

You may upgrade or downgrade your subscription at any time from your billing settings. Upgrades take effect immediately with prorated charges; downgrades apply at the end of the current billing cycle. You may cancel your subscription at any time; upon cancellation, you retain access to the Services until the end of the paid period.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services to transmit content that is illegal, harmful, defamatory, obscene, or that infringes any third party's intellectual property or privacy rights. You must not use the Services to send spam, phishing messages, or any unsolicited commercial communications.

You must not attempt to reverse-engineer, decompile, or disassemble any part of the Services, or interfere with or disrupt the integrity or performance of the Services or related infrastructure. You must not access the Services through automated means other than through our documented API, and any API access must comply with applicable rate limits and usage policies.

StreamCart reserves the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including without limitation removing content, suspending or terminating the offending account, and reporting to law enforcement authorities.

StreamCart and its licensors retain all intellectual property rights in and to the Services, including the software, design, trademarks, and all content created by StreamCart. Nothing in these Terms grants you any right, title, or interest in the Services except for the limited license to use them in accordance with these Terms.

You retain ownership of all content you upload to the Services, including your videos, product images, and store data. By uploading content, you grant StreamCart a limited, worldwide, royalty-free license to host, process, and display that content solely for the purpose of providing the Services to you. You represent that you have all necessary rights to grant this license.

If you submit feedback or suggestions regarding the Services, StreamCart may use such feedback without restriction or compensation to you.

To the maximum extent permitted by applicable law, StreamCart and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising from or in connection with your use of the Services or these Terms, even if StreamCart has been advised of the possibility of such damages.

In no event shall StreamCart's total liability to you for all claims arising out of or relating to these Terms or the Services exceed the total amount paid by you to StreamCart in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

Either party may terminate these Terms at any time. You may terminate by canceling your subscription and ceasing to use the Services. StreamCart may terminate or suspend your access to the Services immediately, without prior notice or liability, if you breach any provision of these Terms or if we determine that continued access would expose StreamCart or others to harm.

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — will survive any termination or expiration of these Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any choice or conflict of law provision. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and StreamCart regarding the Services and supersede all prior agreements.
